EVENT TERMS & CONDITIONS
Please read these Event Terms & Conditions carefully.
These Event Terms & Conditions, taken together with the Participant Release, constitute a binding agreement as to your participation in the Nike After Dark Sydney 21.1km (“After Dark”). After Dark will consist of a 21.1 kilometer race (the “Race”) and a Post-Race Celebration (the “Celebration”) on 12 April 2025 (collectively, the “Event”).
**NOTE: Event, including event date, race course, start/finish locations and distance are subject to council approvals and may be cancelled or changed as required in accordance with these Event Terms & Conditions. Notwithstanding anything to the contrary in these Event Terms & Conditions, if the Event is cancelled because council approval and permits necessary to conduct the Event are not obtained, and in circumstances where a participant’s application has been accepted and their credit card charged, Nike will refund the entry fee. For the avoidance of doubt, and to the maximum extent permitted by applicable laws (and without excluding or limiting any of your rights that cannot by law be excluded or limited), this will not extend to Nike being liable for any other costs, expenses, claims or liability, including without limitation travel, accommodation, or any other expenses.
DO NOT PARTICIPATE IN THE EVENT UNLESS YOU HAVE READ, UNDERSTAND AND AGREE TO THESE EVENT TERMS & CONDITIONS AS WELL AS THE PARTICIPANT RELEASE. These Event Terms & Conditions and the Participant Release supersede any prior understandings or agreements, whether oral or written.
In consideration of being granted an entry to participate in the Event conducted by Nike Australia Pty Ltd (“Nike”), I acknowledge, warrant and agree to the following:
PARTICIPATION OVERVIEW
Race Application: All participants must provide accurate information, including age and emergency contact information, when completing the Event application. Participants must update Nike immediately in case of any changes to emergency contact details or health conditions. Registration Opening & Closing: Registration for participation in the Event will be accepted from 9 January 2025 at 7:00am AEDT until 11:59pm AEDT on 11 February 2025. The Event has a capacity limit and entry is on a first-in-best-dressed basis. Nike reserves the right to close registrations before the end date where Event capacity has been reached. Nike also reserves the right to extend this period at its discretion including where Event capacity has not been reached. Entry fee and application process: The entrance fee for the race is AU$100 including GST. The fee includes access to the expo, a personal bra fitting service and bra, participant race bib, participant tee shirt, and post-race celebration access. As part of the application process, you will be required to provide a credit card number and, should your application be successful, the event registration fees will be debited from your card. Your credit card will not be charged unless you accept these Event Terms & Conditions and Participant Release. The entry fee is processed automatically when submitting a successful application. When completing the application please use a credit card that has an expiration date of March 2025 or later. Your entry is not guaranteed upon application, but only upon you receiving notification that it has been successful and payment in cleared funds is received.
Pace Requirement & Course Completion: Participants must be capable of completing the full distance 21.1 kilometer Race within four hours unless otherwise communicated by Nike. NOTE: Race course/distance is subject to council approvals and may be altered as required. Age Restrictions: To register, you must be 16 years of age or older on Race day. Participant Release: Each participant must read and agree to/sign a Participant Release during the registration process including confirming they are medically fit to participate in the Event and have trained adequately for the Event. If you are under 18 years of age as at Race day your parent or legal guardian must sign a printed Participant Release. The printed Participant Release must be brought to packet pickup and submitted to Nike before a minor will be given a race bib and allowed to participate.
Adaptive athletes and athletes with disabilities: Any participant seeking accommodation in respect of a disability must submit a written request to afterdarktour@nike.com. Entry Transfers: Participant registrations and bibs are non-transferable and cannot be exchanged or sold. The sale or transfer of Race entries or bib numbers is strictly prohibited and may result in disqualification and/or a ban from future events for all parties involved. All entry fees where disqualified for such a breach are non-refundable. Changes in personal circumstances: To the maximum extent permitted by law, except as otherwise specified in the Event Changes and Cancellation section immediately below, all Race entry fees are non-refundable and non-transferable. This includes if you are unable to participate in the Race, for example due to changes in personal circumstances, change of mind, illness, surgeries or injuries. Nothing in these Event Terms & Conditions exclude or limit any term or guarantee which, under statute, cannot be excluded or limited. Where such liability cannot be excluded, but is able to be limited, Nike and the Released Parties limit their liability to the maximum extent permitted by law. In these Event Terms & Conditions, “Released Parties” means Nike and its affiliates and subsidiaries, their respective officers, directors, shareholders, employees, agents, distributors, partners, representatives, contractors, successors, assigns, and insurers, all Event organisers, promoters, sponsors, advertisers, volunteers, and staff, and all owners or lessors of premises used in connection with the Event. Event Changes and Cancellation: Without limiting any other aspect of these Event Terms & Conditions, Nike and Event officials reserve the right to delay, change, cancel or suspend the Event (in whole or in part) due to events beyond their reasonable control, including inclement weather (such as severe thunderstorms, excessive winds or other hazardous conditions) governmental orders, or for any reason whatsoever. In the event of a changed or cancelled Event due to a circumstance beyond Nike’s reasonable control, to the maximum extent permitted by applicable laws and without excluding or limiting any of your rights that cannot by law be excluded or limited, your entry fee will be non-refundable and Nike will not be responsible for any costs incurred by the participant, including travel, accommodation, or any other expenses. Nike will not have any liability or responsibility to the participant in such cases. If the Event is cancelled because council approval and permits necessary to conduct the Event are not obtained, and in circumstances where a participant’s application has been accepted and their credit card charged, Nike will refund the entry fee. Race Number/Bib Pickup: Participants must pick up their own packets. No exceptions. Participants must provide photo ID upon picking up their packet that reflects the name you registered.
Race Number/Bib Pickup: Your official participant bib, which displays your Race number, must be fully visible at all times and worn on the front of your torso on your outermost garment.
RACE DAY
Wave Starts: Participants are responsible for arriving at the start wave assigned to them, based on their best pace, and entering at the designated wave entry points before the wave closing times. Runners may move back to a slower wave but may not move forward to a faster wave. Once a wave is closed for entry, late-arriving participants must report to the next open wave. Participants must arrive with sufficient time to receive race directions. Late arrivals may, at the organiser’s discretion, be moved to another wave or have their registration forfeited.
Race Start: The Race will be started by an air horn unless otherwise noted. All participants must be behind the starting line at the start of the Race and must follow the instructions of the Race starter.
Course Marking: Participants must remain within the designated course boundaries at all times. The course will be marked with barriers, traffic cones, signs, and other indicators. Participants are required to observe and follow all Event signage, symbols, and directions related to the course and facilities, and must comply with the instructions of course marshals and Event officials. Failure to do so may result in disqualification. In addition, participants must yield to emergency vehicles and follow instructions from course marshals regarding temporary diversions or changes in the course.
Official Times: Official finishing times for all runners, except for overall winner, are based on chip time/net time, the time from when the runner crosses the start line until they cross the finish line. The overall winner is the first runner to complete the entire course and cross the finish line. The overall winner’s time is based on gun time or the total time to run from the start to the finish.
Drones: The use of video devices, computers, drones, unmanned aerial devices, or any similar devices are not permitted on or near the Racecourse. Wheeled Devices/Vehicles: Baby strollers, joggers, skateboards, rollerblades, bicycles, motorized devices, and any other wheeled vehicles or devices are not permitted on the Racecourse. Authorized wheelchairs, handcycles, and other devices for participants with disabilities, provided they are pre-approved, are allowed.
SAFETY
Event Officials: Participants must follow instructions as given from all Event officials including staff, volunteers, traffic controllers, medical personnel, fire and police officials, lifeguards, security officers and State Government and local council officials throughout the duration of the Event. Public Health Guidelines: Event attendees must adhere to city, state and other public health guidelines and orders. Event Signage: Participants are responsible for their recognition and understanding of Event signage and symbols relating to participant maps, facilities and directions. Medical Attention: Event medical personnel may examine any participant who appears in distress. If, in the sole opinion of authorized medical personnel, it is in the best interest of the participant’s health and welfare, medical personnel may remove a participant from the Event. Medical Expenses: Participants are responsible and assume liability for any and all medical costs incurred as a result of training for and/or participation in the Event, including but not limited to ambulance transport, hospital stays, physician and pharmaceutical goods and services.
CONDUCT, DISQUALIFICATIONS, & VIOLATIONS
Professional Conduct: All participants are expected to conduct themselves in a courteous and respectful manner throughout the Event. Any participant who engages in unsportsmanlike behavior, including the use of offensive language or actions toward other persons (including Event officials, Event staff, other participants, spectators or volunteers), may be immediately removed from the course, disqualified and banned from future events for a period determined by Nike. Unsportsmanlike conduct includes, but is not limited to, providing false or misleading information on the Event application, or any conduct that, in the sole discretion of Nike, is deemed unethical, unfair, abusive, offensive, harassing, disrespectful, harmful, or illegal. Examples of prohibited conduct include, but are not limited to, alcohol consumption, public urination or defecation (except in designated restroom facilities), and obstruction of other participants or the course. NOTE: Failure to comply with these Event Terms & Conditions, or with other information or directions from Event organizers or their agents, may result in disqualification and forfeiture of registration. Unauthorized Assistance: Any registered participant who receives unauthorized assistance may be disqualified. This includes any registered participant who permits an unregistered runner to run with them for any part of the Race. Disqualified Individuals: Individuals disqualified from the Race will be removed from the Race results and may be barred from future Nike events. Nike reserves the right to reject any entry and to disqualify and bar any individual from any Nike event. This rejection/disqualification may be based on, but is not limited to, the violation of these Event Terms & Conditions. Prohibited Items: The following items are prohibited at the Event:
Backpacks larger than 45cm x 35cm
Glassware or breakable containers and cans
Flammable liquids, aerosol, fuels, spray paint, fireworks, toxic chemicals and explosives
Alcohol
Illicit or dangerous drugs or substances
Offensive/dangerous weapons including guns, knives, hammers, sharp objects, scissors, firearms, laser pointers and potential missiles
Unmanned aerial devices including drones
Non-accredited photographic equipment or recording devices for commercial purposes
Any signs, banners or materials displaying offensive or inappropriate content or unauthorized commercial or promotional content
Bicycles, scooters, skateboards, roller skaters and any other non-approved wheeled devices
Pets other than assistance/service animals
Cigarettes, vaping devices or other smoking devices and tobacco products
Any items which Nike or Event organisers consider to be offensive, dangerous, illegal, threat to public safety or comfort of any person, and/or a possible cause or nuisance or offence
These Event Terms & Conditions are subject to change at the sole discretion of Nike. Nike will provide participants with reasonable notice of any material change to these Event Terms & Conditions. Participants shall be bound by any modification of, or supplement to, these Terms & Conditions. Please contact us if any change to these Event Terms & Conditions affects your decision to participate in the Event. Failure to follow these Event Terms & Conditions, as may be amended, may result in immediate disqualification, loss of any prize and removal from official results.
